The Shiny Squirrel Wrangler Terms of Use
Hey there fellow small biz owner! By purchasing or otherwise enrolling in The Shiny Squirrel Wrangler (hereinafter the “Program”), you, the purchaser or enrollee (hereinafter “Student”), enter into an agreement with The Bluebell Group, LLC (“Company”) and agree to the following terms:
1. Program Deliverables
The Program is a self-paced online mini-course that includes educational content, frameworks, instructions, and downloadable/reference files designed to help Student create and personalize an AI-powered system for evaluating ideas, protecting priorities, and maintaining focus.
Company agrees to provide the content as promised on the Program sales and/or checkout page, which may include:
The Pursue/Park/Pass Framework for evaluating new ideas;
The Shiny Squirrel Wrangler pre-built Claude AI Skill, including its instructions, logic, and supporting files;
The Honest Check framework;
Instructions for creating and maintaining a Squirrel Vault;
Training and instructions for personalizing and implementing the Program materials;
Instructions for adapting or implementing the system using other supported large language models (“LLMs”), such as ChatGPT or Gemini;
Access to updates to the Program that Company makes available during the life of the Program; and
Access to support through The Cold Coffee Club community and/or by contacting Company at admin@thebluebellgroup.com.
Student will retain access to the Program for the life of the Program, meaning for as long as Company offers and maintains the Program. Company will provide Student with at least one month’s notice should Company need to retire the Program. It is then Student’s responsibility to download any downloadable materials from the Program before the retirement date noted by Company.
The Program is currently hosted through Teachery. Company reserves the right to change the platform through which the Program is delivered at any time.
2. Privacy Policy
Company's Privacy Policy is hereby incorporated by reference into this Agreement.
Student understands that Company is providing educational content, tools, and resources to Student. The Program is self-paced and does not include individualized consulting, coaching, or professional services.
Student is responsible for maintaining access to any third-party accounts or services necessary to implement the Program, including an account with Claude or another compatible LLM. At the time of this Agreement, the Program may be implemented using free versions of supported AI platforms; however, Company does not control third-party pricing, account requirements, features, or availability.
3. Payment
In consideration of Student’s access to the Program, Student agrees to pay the price presented at checkout.
The regular retail price of the Program is $97, although Company may periodically offer the Program for a discounted price, promotional price, complimentary access, bundle price, coupon price, or other special offer.
If Student purchases the Program through a promotional offer, Student is responsible only for the amount presented and agreed to at checkout.
Student hereby authorizes Company and its payment processor to charge Student’s credit or debit card for the amount agreed to at checkout.
4. No Refunds
Company has a strict no-refund policy on the Program due to the digital nature of the Program and Student's immediate access to its materials.
Student understands and agrees that all purchases are final and that no refunds will be issued after purchase or enrollment.
5. Payment and Access
Student is responsible for paying any amount agreed to at checkout in full.
Should Student fail to make a required payment, dispute a valid charge, initiate an improper chargeback, or otherwise fail to satisfy Student’s payment obligations, Company may immediately suspend or terminate Student’s access to the Program and pursue any remedies available to collect the balance owed.
Company may terminate Student’s access to the Program for violation of these Terms or misuse of the Program or its materials.
6. No Master Resell Rights or Private Label Rights
Master Resell Rights, Private Label Rights, and other rights of redistribution are not included with the Program.
Student understands that no rights of reproduction, resale, redistribution, sublicensing, or commercial distribution are transferred by this Agreement.
Student may customize or modify the provided AI instructions, files, frameworks, and related materials solely for Student’s own personal or internal business use, including adapting the materials to Student’s goals, priorities, business, workflow, or preferred compatible AI platform.
Student may not sell, resell, share, distribute, publish, sublicense, give away, teach, license, reproduce for others, or otherwise make the original or modified Program materials available to any third party.
Student may not use the Program materials, whether original or modified, to create a substantially similar product, course, template, AI Skill, prompt library, digital resource, or other offering for sale or distribution to others.
7. Intellectual Property
Company owns the rights to all content in the Program, including but not limited to frameworks, methodologies, written materials, instructions, prompts, AI Skill files, reference files, guides, explanations, graphics, logos, images, downloads, videos, and other Program materials.
Student’s participation in the Program does not transfer any intellectual property rights to Student.
Company grants Student a limited, non-exclusive, non-transferable, revocable license to access, use, and customize Program content for Student’s own personal or internal business use in accordance with this Agreement.
Student retains ownership of Student's own original information, business data, goals, ideas, and other materials Student enters into or creates independently of the Program.
8. Force Majeure
Company shall not be liable or responsible to Student, nor be deemed to have defaulted or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement when and to the extent such failure or delay is caused by or results from acts or circumstances beyond the reasonable control of Company including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion, or hostilities (whether war is declared or not), terrorist threats or acts, riot, or other civil unrest, national emergency, revolution, insurrection, epidemic, lock-outs, strikes or other labor disputes (whether or not relating to either party’s workforce), restraints or delays affecting carriers, inability or delay in obtaining supplies of adequate or suitable materials, telecommunications breakdown, internet or technology outages, or power outages.
9. Independent Contractor and Educational Purposes
Nothing in this Agreement shall be construed to create a partnership, joint venture, employment, or agency relationship.
Company agrees only to provide Student with access to the Program, which provides education, information, frameworks, and tools.
The information contained in the Program, including any interactions with Company or use of AI tools created using Program materials, is not intended as, and shall not be understood or construed as, professional legal, financial, medical, mental health, tax, accounting, or other licensed professional advice.
10. Severability
If any provision of this Agreement shall be declared invalid or unenforceable, such provision shall be deemed eliminated from this Agreement, and all remaining provisions shall continue in full force and effect.
11. Liability
STUDENT ABSOLVES COMPANY OF ANY AND ALL LIABILITY OR LOSS STUDENT MAY SUFFER OR INCUR AS A RESULT OF USE OF THE PROGRAM AND/OR ANY INFORMATION, TOOLS, AI OUTPUTS, AND RESOURCES CONTAINED IN OR CREATED THROUGH THE PROGRAM.
TO THE EXTENT PERMITTED BY LAW, STUDENT AGREES THAT COMPANY SHALL NOT BE LIABLE TO STUDENT FOR ANY TYPE OF DAMAGES, INCLUDING DIRECT, INDIRECT, SPECIAL, INCIDENTAL, EQUITABLE, OR CONSEQUENTIAL LOSS OR DAMAGES ARISING FROM USE OF THE PROGRAM.
12. No Warranty or Guarantee
Company makes no representations about the suitability, reliability, availability, timeliness, or accuracy of the information, software, products, services, AI tools, and related materials contained in the Program for any purpose.
To the maximum extent permitted by applicable law, all such information, software, products, services, tools, and related materials are provided “as is” without warranty or condition of any kind.
Company and/or its suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, services, tools, and related materials, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement.
Company does not guarantee any particular business, productivity, financial, organizational, or other result from participation in or use of the Program.
13. Assignment
Student may not assign this Agreement without express written consent of Company.
14. Modification
Company may modify the terms of this Agreement at any time. All modifications shall be posted on Company’s website and purchasers shall be notified as appropriate.
15. Indemnification
Student agrees to indemnify, defend, and hold harmless Company, its officers, directors, employees, agents, contractors, and third parties for any losses, costs, liabilities, and expenses (including reasonable attorneys’ fees) relating to or arising out of Student’s use of or inability to use the Program and related services, any user content or postings made by Student, Student's violation of any terms of this Agreement, Student's violation of any rights of a third party, or Student’s violation of any applicable laws, rules, or regulations.
16. Dispute Resolution
Student expressly waives any and all claims, now or in the future, arising out of or relating to the Program. To the extent Student attempts to assert any such claim, Student hereby expressly agrees to present such claim only in the small claims courts in Warren County, Ohio.
17. AI Tools and Outputs
Any AI tools, instructions, prompts, Skill files, frameworks, or other AI-related resources provided through the Program are offered as supplemental educational and productivity resources.
AI-generated outputs may contain errors, omissions, inaccuracies, outdated information, hallucinations, or other unreliable information. Student is responsible for reviewing, verifying, and exercising independent judgment regarding all AI-generated outputs before relying upon, publishing, sharing, or acting upon them.
AI-generated outputs do not constitute professional legal, financial, medical, mental health, tax, accounting, or other licensed advice.
Company makes no warranty as to the accuracy, completeness, reliability, appropriateness, or fitness of AI-generated outputs and is not liable for any decisions made or actions taken in reliance upon those outputs.
18. Third-Party AI Platforms and Services
The Program is designed for use with third-party artificial intelligence platforms, including Claude, and may provide instructions for adapting Program materials for use with other platforms such as ChatGPT or Gemini.
These platforms are owned and operated by third parties and are not controlled by Company.
Student understands that third-party platforms may change their features, functionality, user interfaces, models, usage limits, pricing, subscription requirements, terms of service, privacy practices, availability, compatibility, or other aspects of their services at any time.
Company does not guarantee that any particular AI platform, feature, model, or free account tier will remain available or compatible with Program materials indefinitely.
Company may provide reasonable Program updates or updated instructions when Company determines they are appropriate, but Company is not responsible for changes, interruptions, errors, data loss, account restrictions, outages, discontinued features, or other actions caused by third-party platforms.
Student is responsible for reviewing and complying with the terms, privacy policies, and acceptable-use requirements of any third-party platform Student chooses to use.
19. Student Data and AI Privacy
Student is responsible for determining what information Student chooses to provide to any third-party AI platform while using the Program.
Company does not control how third-party AI providers collect, store, process, use, or retain information submitted directly to their services.
Student agrees not to enter confidential, proprietary, sensitive, personally identifiable, client-protected, or other information into an AI platform unless Student has determined that doing so is appropriate and permitted under the applicable platform's terms and privacy practices and any laws, contracts, or professional obligations applicable to Student.
20. Testimonials and Feedback
Student understands that Student may voluntarily provide Company with testimonials, reviews, comments, feedback, success stories, photographs, screenshots, or other statements regarding Student’s experience with the Program.
By voluntarily submitting such material to Company for testimonial, promotional, or marketing purposes, Student grants Company permission to use, reproduce, publish, display, edit for length or clarity without materially changing its meaning, and distribute the submitted material in Company’s marketing, advertising, website, social media, email marketing, sales pages, and other promotional materials.
Company will not materially alter the substance or meaning of Student’s testimonial.
Where Student has expressly authorized Company to identify Student, Company may use Student’s name, business name, photograph, likeness, and/or other identifying information provided with the testimonial.
Student may contact Company at admin@thebluebellgroup.com to request that Company discontinue future use of a testimonial. Company will make reasonable efforts to discontinue future use, although Student understands that Company may not be able to recall materials already printed, published, distributed, or incorporated into previously created materials.
